U.S. Court of Appeal for the Tenth Circuit has posted proposed rule changes; Public comment ends 10/25/19

The U.S. Court of Appeals for the Tenth Circuit has posted proposed changes to its local rules. The public comment period will officially end on October 25, 2019. The link to the website can be found here.
Some of the proposed changes include:
- 10th R. 27.6 (Motions to Extend Time)- The deadline to file a motion for extension of time will be changed to 3 days prior to the due date. The current rule requires the motion to be filed 5 days prior to the due date.
- 10th R. 28.1(A)(1) & (2) (Citing to the Record and Appendix)- Parties will be required to cite to both the page number and volume number when citing to the record or appendix. The current rule only requires parties to cite to the page number.
- 10th R. 30.1 (Filing the Hard Copy of the Brief and Appendix)- Hard copies of the brief and appendix will no longer be required to be filed at the same time the electronic version is filed. Now, the court will review the e-filed brief for rule compliance and the hard copies will be due within 5 days following receipt of notice from the clerk’s office that the electronic filing is compliant.
- 10th R. 30.1(D)(1) (Paginating the Appendix)- The proposed rule requires consecutive pagination within a single appendix volume and makes consecutive pagination across multiple appendices optional. The current rule requires consecutive pagination across multiple appendices.
